Medical Malpractice Reporting
  • Reports must be filed by each company writing malpractice insurance for health care providers.
  • Two types of reports: Aggregate Report and Individual Claim Report.
  • Reports are due March 1 of each year.
  • Information will assist with analysis of medical malpractice market in Wyoming.
  • Information on reports is summarized annually and reported to the Governor.
  • Specific, identifiable information in reporting forms is confidential.

Who must file the Aggregate Report

  • Entities writing malpractice insurance for health care providers.
  • Any insurer having issued a medical malpractice policy during the reporting period.
  • Reporting period for the aggregate report is the preceding calendar year.
  • Includes non-admitted insurers issuing coverage through surplus lines.
  • If a claim is noted on the Aggregate Report, an Individual Claim Report must also be filed (see information below).

Who must file the Individual Claim Report

  • Any insurer with an open medical malpractice claim during the preceding calendar year.
  • An updated report is required for previously reported open claims.
  • A final report is required when a claim is closed.
  • Individual Claim Reports may be submitted at any time.
  • If claims are noted on the Aggregate Report, individual claim reports must be filed.

How to File

  • Both reporting forms are due on or before March 1 of each year.
